Car Social Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, mobile applications, products, features, and services provided by Car Social LLC (“Car Social,” “we,” “us,” or “our”), collectively referred to as the “Services.”
By creating an account, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Services.
Certain features described in these Terms may not currently be available and may be introduced as Car Social develops.
1. About Car Social
Car Social is an automotive platform designed to connect enthusiasts, vehicles, events, clubs, automotive businesses, content creators, event organizers, and other participants in the automotive community.
Car Social may provide features involving vehicle profiles and garages, events, clubs, businesses, content creators, social interaction, community discussions, location-based discovery, challenges, leaderboards, performance information, bookings, transactions, and other automotive experiences.
Features may be added, changed, suspended, or removed as the platform evolves.
2. Eligibility
You must be at least 13 years old to create a Car Social account or use account-based Services.
If you are under the age of majority where you live, your parent or legal guardian must consent to your use of the Services where required by applicable law.
Certain features, including transactions, location-sharing functionality, contests, or other activities, may have additional or higher age requirements.
You may not use Car Social if you are legally prohibited from doing so.
3. Your Account
You are responsible for providing accurate information, maintaining the security of your account credentials, and all activity occurring through your account.
You may not impersonate another person or organization, create an account using information you are not authorized to use, sell or transfer your account without permission, or use Car Social for fraudulent or deceptive purposes.
Notify us promptly if you believe your account has been compromised.
Car Social may require verification of certain accounts, businesses, organizations, or activities.
4. Acceptable Use
You agree to use Car Social lawfully and responsibly.
You may not use the Services to:
Harass, threaten, stalk, exploit, or harm others
Promote hatred, violence, or unlawful discrimination
Engage in fraud, scams, impersonation, or deceptive practices
Post unlawful, defamatory, infringing, or malicious content
Distribute malware or attempt to compromise Car Social or its users
Circumvent security, authentication, rate limits, or access controls
Scrape, harvest, or collect information from Car Social without authorization
Spam users or send unauthorized commercial communications
Manipulate ratings, reviews, referrals, challenges, leaderboards, or engagement
Create fake accounts, reviews, events, businesses, clubs, results, or activity
Violate another person's privacy or intellectual-property rights
Use Car Social to facilitate unlawful activity
Interfere with the operation or integrity of the Services
We may investigate suspected violations and take appropriate action.
5. Automotive Safety and Responsible Driving
Car Social does not encourage, organize, authorize, or endorse illegal street racing, reckless driving, speeding, dangerous driving, or violations of traffic laws.
You are solely responsible for operating any vehicle safely and in accordance with applicable laws.
Car Social features, information, challenges, leaderboards, performance tools, maps, community activity, or other functionality must not be interpreted as permission or encouragement to violate traffic laws or endanger yourself or others.
Performance driving should take place only in appropriate and lawful environments, such as authorized tracks, drag strips, closed courses, or other locations where the activity is legally permitted and appropriate safety precautions are in place.
Never interact with Car Social in a manner that distracts you while operating a vehicle.
Car Social is not responsible for accidents, injuries, citations, property damage, vehicle damage, or other consequences resulting from driving decisions or activities undertaken by users.
6. Performance Features, Challenges and Leaderboards
Car Social may introduce vehicle-performance features, challenges, competitions, achievements, points, badges, and leaderboards.
Performance measurements may be based on GPS, device sensors, user-submitted information, third-party data, calculations, or other technology.
Car Social does not guarantee the accuracy, reliability, or suitability of performance measurements.
Performance information provided through Car Social should not be relied upon as professional timing equipment, diagnostic information, safety information, or proof of vehicle performance.
Users may not falsify results, manipulate measurements, exploit software, misrepresent vehicle information, or otherwise interfere with the integrity of challenges or leaderboards.
Car Social may remove or invalidate results that we reasonably believe are inaccurate, manipulated, unsafe, fraudulent, or inconsistent with applicable rules.
7. Location and Live Map Features
Car Social may offer location-based functionality, including a Live Map and features allowing users to discover events, businesses, clubs, content, or participating users nearby.
Location information may be approximate, delayed, incomplete, or inaccurate.
You control whether you participate in optional location-sharing features, subject to the settings and functionality Car Social makes available.
Do not rely on Car Social location information for emergency services, navigation, personal safety, or any situation requiring precise or guaranteed location information.
You may not use Car Social's location features to stalk, harass, threaten, surveil, track, or endanger another person.
Car Social may restrict or terminate access to location functionality when necessary for safety, security, privacy, or legal reasons.
8. User Content
Car Social may allow you to submit photographs, videos, vehicle information, posts, comments, reviews, messages, event information, business information, club information, profile information, and other materials (“User Content”).
You retain ownership of your User Content.
By submitting User Content to Car Social, you grant Car Social a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, distribute, modify as necessary for formatting or technical purposes, and otherwise use your User Content to operate, provide, improve, promote, and market the Services.
This license allows Car Social, for example, to display your vehicle photos on your profile, generate previews or thumbnails, display public content elsewhere within Car Social, and promote publicly posted Car Social content through Car Social's marketing channels.
You represent that you have the necessary rights and permissions to submit the content and grant this license.
You remain responsible for your User Content.
9. Content Creators and Submitted Media
Car Social may provide programs or functionality specifically for content creators, photographers, videographers, or other media contributors.
Additional terms may apply to content submitted through a creator program or other specific arrangement.
Where separate creator terms or agreements exist, those terms will govern in the event of a conflict concerning content submitted under that program.
Car Social may establish rules regarding attribution, licensing, removal, program participation, and use of previously accepted media.
10. Intellectual Property and Copyright
Car Social respects intellectual-property rights.
You may not upload or distribute content that infringes another person's copyrights, trademarks, publicity rights, or other intellectual-property rights.
If you believe content available through Car Social infringes your rights, contact us at support@carsocialapp.com with sufficient information for us to investigate the request.
We may remove allegedly infringing content and may restrict or terminate accounts of repeat infringers where appropriate.
11. Car Social Intellectual Property
The Car Social name, logos, branding, software, interfaces, designs, graphics, databases, technology, features, and other materials created by or for Car Social are owned by Car Social or its licensors and are protected by applicable intellectual-property laws.
These Terms do not grant you ownership of Car Social's intellectual property.
You may not copy, modify, reverse engineer, sell, license, reproduce, or commercially exploit Car Social's proprietary technology or materials except as permitted by law or with our written authorization.
12. Events and Event Listings
Car Social may allow users, organizers, or Car Social itself to list automotive events.
Unless explicitly stated otherwise, Car Social is not the organizer, promoter, owner, sponsor, or operator of third-party events listed on the platform.
Event information may originate from organizers, users, publicly available sources, or other sources. Although we may attempt to maintain accurate information, Car Social does not guarantee that event dates, times, locations, admission requirements, availability, rules, cancellations, or other details are accurate or current.
Users should verify important event information with the applicable organizer before traveling or making purchases.
Attendance at an event is at your own risk. Car Social is not responsible for injuries, accidents, cancellations, losses, disputes, property damage, or other circumstances arising from attendance at or participation in third-party events.
Event organizers are responsible for obtaining necessary permits, permissions, insurance, and approvals for events they organize.
13. Clubs and Organizations
Car Social may allow clubs and other organizations to establish a presence on the platform.
Unless expressly stated otherwise, Car Social does not own, manage, endorse, or control independently operated clubs.
Club owners and administrators are responsible for their organizations, membership decisions, activities, events, communications, and compliance with applicable laws.
Car Social may remove or restrict clubs that violate these Terms or other platform policies.
14. Automotive Businesses
Businesses may create or claim profiles, advertise products or services, communicate with users, receive reviews, and use other business functionality offered by Car Social.
Unless expressly stated otherwise, Car Social does not endorse, certify, guarantee, or warrant any business or the quality, safety, legality, or suitability of its products or services.
Users are responsible for evaluating businesses before purchasing products or services.
Businesses are responsible for the accuracy of their listings, qualifications, licensing, pricing, representations, products, services, and compliance with applicable laws.
15. Bookings, Marketplace Features and Transactions
Car Social may introduce functionality allowing users to request or book automotive services, make payments, purchase products or services, communicate with businesses, reschedule appointments, request refunds, or conduct other transactions.
Unless explicitly stated otherwise, Car Social provides the technology facilitating interactions between users and independent businesses and is not the provider of the underlying automotive service or product.
Additional transaction, cancellation, refund, no-show, payment, or marketplace terms may apply.
Businesses remain responsible for providing their products and services.
Users remain responsible for understanding the terms of their transactions before completing them.
Payment processing may be performed by third-party payment providers subject to their own terms and policies.
16. Reviews and Ratings
Car Social may allow users to review events, businesses, organizers, transactions, or other experiences.
Reviews must reflect genuine experiences and may not be fabricated, purchased, manipulated, retaliatory, fraudulent, or submitted in exchange for undisclosed compensation.
Car Social may identify certain reviews as associated with verified transactions or interactions when appropriate.
We may remove reviews that violate our policies, but we do not guarantee the accuracy of reviews submitted by users.
17. Founding Members
Car Social may recognize eligible early users as Founding Members and assign unique Founder numbers or other recognition.
Founder numbers, badges, benefits, early-access opportunities, and related features are subject to program rules established by Car Social.
Early access may involve beta, preview, staged, or pre-release software that could contain bugs, incomplete features, or other issues.
Founder status does not represent ownership, equity, voting rights, financial interest, employment, or any other ownership interest in Car Social LLC.
Car Social may revoke benefits or status obtained through fraud, abuse, duplicate accounts, manipulation, or violations of these Terms.
18. Referrals, Rewards and Promotions
Car Social may offer referrals, rewards, contests, promotions, challenges, or similar programs.
Additional rules may apply to individual programs.
You may not manipulate referral systems, create fake accounts, engage in self-referral schemes where prohibited, use automated methods, or otherwise attempt to obtain benefits fraudulently.
Car Social may invalidate fraudulent activity and modify or discontinue programs subject to applicable law.
19. Third-Party Services and Links
Car Social may integrate with or link to third-party websites, payment processors, event platforms, social networks, maps, businesses, authentication providers, or other services.
Car Social does not control these third parties and is not responsible for their content, availability, security, products, services, or practices.
Your use of third-party services may be governed by separate terms and privacy policies.
20. Moderation and Enforcement
Car Social may, but is not obligated to, review, moderate, restrict, remove, or disable access to content or accounts.
We may take action when we reasonably believe content or conduct violates these Terms, applicable law, community standards, intellectual-property rights, safety requirements, or the integrity of the platform.
Actions may include warnings, content removal, feature restrictions, suspension, account termination, invalidation of results or rewards, and other appropriate measures.
21. Account Suspension and Termination
You may stop using Car Social at any time and may request account deletion through available account controls or by contacting us.
We may suspend, restrict, or terminate access when reasonably necessary, including for violations of these Terms, fraud, security threats, illegal activity, abuse, repeated infringement, risks to users, or risks to Car Social.
Certain provisions of these Terms that by their nature should survive termination will continue to apply, including intellectual-property provisions, licenses where applicable, disclaimers, limitations of liability, and dispute provisions.
22. Changes to the Services
Car Social is an evolving platform.
We may introduce, modify, test, suspend, discontinue, or replace features at any time.
We do not guarantee that any particular current or announced feature will remain available permanently or launch on a particular date.
Previews, concepts, roadmaps, planned functionality, or announcements concerning future features are informational and do not constitute a guarantee that a feature will be released or released in a particular form or timeframe.
23. Availability and Reliability
We work to provide a reliable platform but cannot guarantee uninterrupted or error-free operation.
Car Social may occasionally be unavailable because of maintenance, updates, technical problems, third-party failures, security incidents, or circumstances outside our control.
We may perform maintenance and deploy updates without prior notice when reasonably necessary.
24. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
Car Social disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade to the extent permitted by law.
We do not warrant that information provided through Car Social is complete, accurate, reliable, current, or suitable for any particular purpose.
Nothing on Car Social constitutes professional automotive, mechanical, legal, financial, safety, or other professional advice.
25. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAR SOCIAL LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES.
This includes, where permitted by law, losses arising from vehicle damage, accidents, events, businesses, user interactions, user content, transactions, data loss, lost profits, unauthorized account access, third-party conduct, performance activities, location information, or inability to access the Services.
To the maximum extent permitted by applicable law, Car Social's aggregate liability for claims arising from or relating to the Services will not exceed the greater of $100 or the amount you paid directly to Car Social during the 12 months preceding the event giving rise to the claim.
Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.
26. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Car Social LLC and its owners, officers, employees, contractors, affiliates, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from or relating to:
Your use or misuse of the Services
Your User Content
Your violation of these Terms
Your violation of applicable law
Your violation of another person's rights
Events, businesses, clubs, products, or services you operate or provide through Car Social
Car Social reserves the right to control the defense of matters subject to indemnification where permitted by law.
27. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
28. Disputes
Before initiating formal legal proceedings, you and Car Social agree to make a reasonable good-faith effort to resolve disputes informally.

Any dispute that cannot be resolved informally will be handled as provided by applicable law and any additional dispute-resolution provisions Car Social may lawfully adopt.
Nothing in these Terms eliminates rights that cannot legally be waived.
29. Changes to These Terms
We may update these Terms as Car Social develops, our business practices change, or legal requirements evolve.
When we make changes, we will update the applicable date. For material changes, we may provide additional notice through the Services, by email, or through another appropriate method.
Continued use of Car Social after updated Terms become effective constitutes acceptance where permitted by law. Where applicable law requires additional consent, we will request it.
30. General Terms
If any provision of these Terms is determined to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
Our failure to enforce a provision does not waive our right to enforce it later.
You may not assign your rights or obligations under these Terms without our consent. Car Social may assign these Terms as part of a merger, acquisition, restructuring, sale of assets, or similar transaction.
These Terms, together with incorporated policies and any applicable supplemental terms, constitute the agreement between you and Car Social regarding the Services.
